Under the new Building Act, a garage always requires a permit for the intended change of use. A shelter without walls up to 40 m2 often does not. We will explain the difference and handle all paperwork on your behalf.
The new Building Act No. 283/2021 Coll., effective from 1 July 2024, classifies buildings into minor, simple, reserved and other categories. A garage is explicitly excluded from minor structures., so regardless of size and material (masonry, prefabricated or sheet metal), it requires development consent. The previous "notice" no longer exists; there is now a single procedure, which can be expedited for simple constructions.
Carport without perimeter walls A structure with a footprint of up to 40 m2 and a height of 5 m on the plot of a detached house is generally classified as a minor construction, provided it stands at least 2 m from the plot boundary and, after its placement, at least half of the plot remains capable of absorbing rainwater. In such cases, neither a permit nor a notification is required.
Rules vary in detail depending on the municipality and local development plan. We always verify the specific plot at the building authority before we start drawing.
A garage built 1.5 m from the boundary without neighbours' consent will not be approved by the authority and neighbours may challenge it even after completion. We draw setbacks according to regulations and the land registry, not by eye.
Rainwater from the roof must remain on your property. Without infiltration or a tank in the project, the application is returned. We resolve this immediately in the design.
A carport that you later enclose with walls ceases to be a minor structure. If you plan to add walls, we will design a garage and the permit from the start.
A unified permit that replaced the building permit and notification as of 1. 7. 2024. The application is submitted to the building authority with project documentation; for simple structures such as a garage, an expedited procedure applies if you have consents from affected owners and relevant statements.
Generally, a 2 m setback from the boundary is required. Construction closer to or directly on the boundary is possible only with an exception and neighbours' consent, without windows or doors facing them, and with a solution ensuring roof water does not flow onto the neighbouring plot. For a fully prepared application, the authority's deadlines range in weeks; in practice, allow one to three months including obtaining statements. Therefore, we start with the permit immediately after surveying, concurrently with construction preparation.
